Carefully Preparing Your Bankruptcy Case
To get the most out of bankruptcy protection requires careful preparation. Filing bankruptcy means giving the bankruptcy court and bankruptcy trustee significant authority over your finances and assets. It is always preferable to know in advance how the court is going to apply the rules of bankruptcy in your case.
At John T. Turco & Associates, in Omaha, our experienced bankruptcy lawyers provide hands-on attention to each client's case, diligently preparing for an effective filing by examining all of the documents needed for bankruptcy. Double-Checking Everything to Avoid Surprises
Under the new bankruptcy laws adopted in 2005, all the claims you make when filing bankruptcy must be documented, and your attorney has a responsibility to double-check these documents. It will be helpful if you can bring in all of the following to your initial consultation:
- Seven months of bank statements
- Seven months of pay stubs from all employers
- Seven months of self-employed profit and loss statements
- Tax returns from the past two to four years
- A copy of each of your current bills
We look over these documents because we are required to do so by law, but also for your own protection. If we do not know everything about your assets, debts and other financial circumstances before we file for bankruptcy, there could be unexpected financial and property consequences, or you could end up in jail for bankruptcy fraud.
Giving You Smart Advice Based on Your Goals
In addition to financial documents, you should also come to your bankruptcy consultation with a general sense of what you are hoping to accomplish by potentially filing for bankruptcy. Different people file for bankruptcy for different reasons.
Which debts are most responsible for pushing you over the line? What are your financial and personal goals for your life after bankruptcy? Knowing these things will allow us to give you sound advice based on our long experience with bankruptcy. Contact us to discuss how we can help you.
